Although law in just six states, CCA is attracting interest in other states.

Pennsylvania nearly became the seventh CCA state, but its public utilities commission determined that CCA’s opt-out provision was akin to “slamming,” or the practice of switching customers’ service without their knowledge or consent. The commissioners remain unswayed by the fact that customers receive multiple notifications of opportunities to remain with their existing service and that the offering of CCA service must be approved by a public vote. Until clarifying legislation is passed, the commission will require CCAs to receive its approval before proceeding.

Utah communities with climate action plans are looking to decrease the heavy coal content of the electricity they receive from Rocky Mountain Energy. CCA may provide a route forward.

New York communities with climate action plans and an interest in aggregated energy efficiency and microgrid pilots are researching CCA as a promising avenue.

After passing a municipalization measure in 2011, the City of Boulder in Colorado is exploring acquisition of distribution infrastructure from the existing utility, Excel, and seeing value in pursuing CCA legislation.
